You don’t have to hire a lawyer to apply for a trademark. However, an attorney definitely makes getting a trademark a much easier process. It all starts well before the application is filed in the searching stage. I can’t speak for every firm, but here are the services I provide for each and every client:

  • I start out by searching federal, state, common law, and internet databases for any trademarks similar to the one you’d like to file. This initial search ensures that you won’t waste time and money trying to file a trademark that doesn’t stand a chance of being accepted by the United States Patent and Trademark Office (USPTO). If I find anything that looks problematic, I’ll report to you, advising you on the proper course of action.
  • Once everything is good to go, I will prepare your trademark application and file it electronically with the USPTO. Depending on the exact type of trademark application you’re filing, the wait time could be as long as six to seven months (assuming no Office Actions are issued, more on how long it takes to get a trademark here). Getting a trademark does not happen in just a couple of weeks!
  • If you have any questions about the process, you’re entitled to an unlimited number of telephone consultations to ensure you understand where you stand.
  • Once your trademark application has been approved, our work continues. I will perform regular searches of the USPTO database, looking for any confusingly similar trademarks that may be infringing upon your protected rights.
  • Getting a trademark for the first time doesn’t mean you have it forever. You have to continue using it to sell goods and/or services and file the proper maintenance and renewal documents.
