1. What is a trademark or service mark?

A trademark is a name, symbol, word or device that businesses use to distinguish their goods from similar products and to identify their source. Service marks are similar, but they are used to distinguish services from others and to identify their source. If trademarks or service marks are registered with the USPTO, they provide nationwide protection against other businesses using the same or similar marks for their own products. Trademarks do not stop other businesses from offering similar products or services, however.

2. How long will a trademark last?

Once you have registered your trademark with the USPTO, your rights in it can last indefinitely if you continue to use the mark in connection with your goods or services and file the required documentation at the appropriate times. 3. What is required to renew a trademark?

Once you secure your initial trademark registration from the USPTO, it will last for six years. After the five-year anniversary has passed, you will need to submit a section 8 form to the USPTO. This form informs the USPTO that you are still using your trademark. Your trademark’s registration will then be extended to 10 years. When the ninth anniversary passes, you will then need to submit a section 8 and 9 form to the USPTO. Every 10 years after that, you will need to submit a new section 8 and 9 form to continue your trademark rights.

Working with a Trademark Attorney

It is possible for businesses to secure trademarks without hiring an attorney to help them. The USPTO has the application form on its website as well as a search engine. Choosing to work with an experienced trademark lawyer may be a better option, however. Businesses have a 50 times greater likelihood of securing their trademark registrations when they have the help of a trademark lawyer.

In order to be registered, your trademark cannot be similar to any other trademarks that have already been registered.
