Ionthis

Ionthis was formed by engineering professionals experienced in manufacturing USA products in China as a way for small to medium companies to gain access to manufacturing in China to reduce cost or to extend manufacturing capabilities and/or capacity without sacrificing quality. Iroiro

Our product was created out of pure love, a love for a teenage girl who wanted a cool, vibrant and exciting hair color. One day my business partner faced a dilemma: whether or not to allow his one and only daughter, Paige, to dye her hair pink. He asked me, “What should I do?” I said, “Why not? Everyone does it.” Then we checked the labels of semi-permanent hair dyes in the market. We must have checked almost all the brands. Unfortunately, they all contained dangerous chemicals and synthetic ingredients. After careful consideration, we decided to create our own semi-permanent hair dyes. We knew we can do better, and so we did!

Common FAQs from Houston Businesses

1. How much will applying for a trademark cost?

The USPTO charges a $350 fee for each group of services or products that you submit along with your filed trademark application. The fees that your trademark attorney charges to research and evaluate your trademark and to prepare and submit your application are separate. If objections are filed against your trademark, you should expect additional fees. In some cases, The Law Office of Xavier Morales is willing to negotiate affordable flat fees for trademark applications.

2. How long does the trademark application process take?

If there are no problems with your trademark application and it is clean, you may receive your trademark registration in a little less than one year. From the date that you submit your application, it will take an average of four to six months for the USPTO to review it. If the attorney who examines your application does not identify any problems with it, the USPTO may then proceed on to the publication phase of your trademark. If no objections to your trademark are made, you may possibly receive your registration within nine months. Most commonly, however, the registration process takes an average of 13 to 18 months because of office actions and other delays that can occur.

3. How and when are trademarks renewed?

After you receive your initial trademark registration, the trademark will be good for six years. At five years, you must file a section 8 declaration form with the USPTO stating that your trademark is still in use. Following the ninth-year anniversary of your trademark registration, you will need to file a combined section 8 and 9 declaration form. This will renew your registration at the 10-year mark. From then on, you will need to renew your registration every ten years.

Working with a Trademark Attorney

You do not have to hire a lawyer to help you with your trademark application. People are able to submit their applications on their own via the USPTO’s online application form on its website. However, choosing to work with a trademark attorney may be beneficial. People who retain the services of experienced trademark lawyers have a 50 times greater likelihood of being successful with their registrations than people who do so without help. If your application is denied, you will have to start over and will not be refunded your filing fee.

The trademark application is extremely complicated, and if you make an error on it, it may be rejected. An experienced trademark attorney can help you by making sure that it is accurately completed. He or she may also research your chosen trademark and evaluate it to make certain that no one else has already registered something similar and that your trademark follows the law.
