The USPTO charges a $350 fee for each group of services or products that you submit along with your filed trademark application. The fees that your trademark attorney charges to research and evaluate your trademark and to prepare and submit your application are separate. 2. How long does the trademark application process take?
If there are no problems with your trademark application and it is clean, you may receive your trademark registration in a little less than one year. From the date that you submit your application, it will take an average of four to six months for the USPTO to review it. If the attorney who examines your application does not identify any problems with it, the USPTO may then proceed on to the publication phase of your trademark. If no objections to your trademark are made, you may possibly receive your registration within nine months. Most commonly, however, the registration process takes an average of 13 to 18 months because of office actions and other delays that can occur.
3. How and when are trademarks renewed?
After you receive your initial trademark registration, the trademark will be good for six years. At five years, you must file a section 8 declaration form with the USPTO stating that your trademark is still in use. Following the ninth-year anniversary of your trademark registration, you will need to file a combined section 8 and 9 declaration form. This will renew your registration at the 10-year mark. From then on, you will need to renew your registration every ten years.
