Can I Trademark a Pharmaceutical?

You can trademark the name, logo, or slogan that you use to sell your particular pharmaceutical products. For example, “CYMBALTA” is a registered trademark for pharmaceutical products.

This information was provided by our founding attorney, Xavier Morales, Esq.

In order to trademark your product name, it cannot be a generic word associated with your industry, and the name must take on a secondary meaning associated specifically with your product.

Registering a trademark for your pharmaceutical will prevent any competitors from using the registered name, slogan, or logo to promote their product. A trademark will not prevent a competitor from producing a similar medication, nor will it prevent the name or slogan from being used in common speech.

You should contact our associates today if you are considering registering a trademark for your pharmaceutical.
